OFFICIAL CONTEST RULES AND REGULATIONS
Free Fall 2009 Contest (the “Contest”) A Contest Sponsored by Wakefield Canada Ltd. (the “Sponsor”)
CONTEST DURATION
The Contest starts on Friday, August 14, 2009 at 9:00 AM ET and ends on Friday,October 15, 2009 at 9:00 PM ET (the “Contest Period”).
PRIZES
GRAND PRIZE: There are three (3) Grand Prizes available to be won in this Contest, each consisting of a Ten Thousand Dollar ($10,000) Canadian Tire Gift Card. Approximate retail value of each Grand Prize is $10,000.00 CAD.
SECOND PRIZES: There are three (3) Second Prizes available to be won in this Contest each consisting of one (1) free gas for a year certificate with a maximum value of $3,000.00, approximate retail value of each Second Prize is $3,000.00 CAD.
TELL A FRIEND PRIZE: There is one (1) Tell-A-Friend Grand Prize available to be won in this Contest, consisting of one (1) Five Hundred Dollar ($500) Canadian Tire gift card. Retail value of the Tell A Friend Prize is $500.00 CAD.
The Prizes in this Contest must be accepted as awarded and cannot be transferred, assigned, changed, substituted for another prize, or exchanged in whole or in part, for cash, subject to the provisions set forth elsewhere in these Official Contest Rules and Regulations.
Odds of winning a Grand Prize or Second Prize in this Contest depends upon the number of eligible entries received during the Contest Period. Odds of winning a Tell a Friend Prize depend on the number of eligible tell-a-friend entries received during the Contest Period.
HOW TO PARTICIPATE
Unique Contest PIN codes are available on specially-marked 4.4 litre bottles of Castrol motor oil, received with oil changes at participating Canadian Tire Automotive Service Centres and without purchase by mail-in request. Contest PIN codes are available while supplies last.
There are two (2) ways to enter this Contest: 1. ON THE WEB. You may enter the Contest by visiting the Free Fall 2009 Contest web site at www.changeyouroilchangeyourlife.com. Fully complete the entry form, enter the unique PIN code found on specially-marked 4.4 litre bottles of Castrol motor oil, received with your oil change at participating Canadian Tire Automotive Service Centres or received by no purchase request by mail (as described below), confirm compliance with the Contest rules and press “submit” and you will be automatically entered into the Contest.
2. BY MAIL: You may also enter by mail by fully completing the Official Entry Form found on specially-marked 4.4 litre bottles of Castrol motor oil, received with your oil change at participating Canadian Tire Automotive Service Centres or received by no purchase request by mail by printing your complete name, address, city, province, postal code, age and telephone number and mail together with your Contest PIN to FREE FALL 2009 CONTEST, 77 John Street, Suite 4, Oakville, Ontario L6K3W3.
TO OBTAIN A PIN CODE WITHOUT A PURCHASE. To obtain a Free Fall 2009 Contest PIN without purchase, mail a fifty (50) word essay on the topic of how you maintain your vehicle along with a self-addressed, postage-stamped envelope to FREE FALL 2009 CONTEST, 77 John Street, Suite 4, Oakville, Ontario L6K3W3. You will receive a unique Contest PIN code (available while supplies last) and an Official Entry Form. Upon receipt of your Contest PIN code, you may enter by visiting the Contest web site at www.changeyouroilchangeyourlife.com per point 1 above or send your entry by mail per point 2 above. No Purcharse requests must be received by September 21, 2009 to allow for sufficient time to process the request. Limit of one mail-in request per person.
Entries must be received between Friday, August 14, 2009 at 9:00 AM ET and Tuesday, October 15, 2009 at 9:00 PM ET to be eligible for the Prize draws.
Limit one (1) entry per person for the Grand Prize and Second Prizes draw. You can also enter for a chance to win the Tell A Friend Prize if, at the time of entry you tell a friend about this Contest using the “Tell A Friend” web site function in which you will receive one (1) additional entry for every friend you tell. Limit of five (5) “Tell A Friend” entries per person. “Tell A Friend” entries will be eligible for the “Tell A Friend” Prize. Entrant warrants and represents that he/she has permission to share the email addresses and names of the friends being referred.
No responsibility is assumed by the Sponsor, Canadian Tire Corporation, Limited, Canadian Tire Financial Services Ltd., Canadian Tire Associate Dealers, Canadian Tire Petroleum Agents, Mark’s Work Wearhouse, their affiliates, subsidiaries and each of their respective shareholders, directors, employees, agents and representatives (collectively, the “Canadian Tire Parties”), and each of their respective affiliates, subsidiaries, advertising and promotional agencies, their respective directors, officers, employees and assigns, for any disruption to telephone network or lines, computer on-line systems, servers or providers, computer equipment, software or failure of any entry to be received because of technical problems or traffic congestion on the Internet or at any web site, or any combination thereof, as well as lost, misdirected, illegible, or late entries which for any reason are not received.
The Sponsor and the Canadian Tire Parties assume no responsibility for lost, late, stolen, misdirected, postage-due mutilated, incomplete or illegible entries or no purchase requests, as well as any printing, administrative or other error of any kind in connection with this Contest. The Sponsor and the Canadian Tire Parties assume no responsibility or liability resulting from user attempts to participate in this Contest or, if required, download any information necessary to participate in this Contest.
ELIGIBILITY
This Contest is open to legal residents of Canada who have reached the age of majority in their province of residence at the time of participation in this Contest.
You are not eligible if you are an employee, representative or agent of the Canadian Tire Parties, the Sponsor, or any of their affiliates, subsidiaries, parent or related companies, advertising or promotional agencies or a member of the immediate family (spouse, child, sibling, parent) or household of any of the above persons.
SELECTION PROCESS
GRAND PRIZE DRAWS
On Friday, October 30, 2009 at approximately 10:00 AM ET in Oakville, Ontario, three (3) selected entrants will be randomly drawn from all eligible entries received for the Grand Prizes available in this Contest.
SECOND PRIZE DRAWS
On Friday, October 30, 2009 at approximately 10:15 AM ET in Oakville, Ontario, three (3) selected entrants will be randomly drawn from all eligible entries received for each Second Prize available in this Contest.
TELL A FRIEND PRIZE DRAW
On Friday, October 30, 2009 at approximately 10:30 AM ET in Oakville, Ontario, one (1) selected entrant will be randomly drawn from all eligible entries received for the Tell A Friend Prize available in this Contest.
The selected entrants will be contacted by telephone, no voicemail message will be left. In the event a selected entrant cannot be contacted within five (5) days of the selection date, another entrant will be selected in accordance with these Official Contest Rules.
In order to be declared a Winner of a Prize, each selected entrant must complete and sign a Release & Indemnity Form and correctly answer, unaided, a time-limited mathematical skill-testing question, without assistance or electronic aid, to be administered at a mutually convenient time over the telephone. There will be only one (1) opportunity to answer the mathematical skill-testing question. A selected entrant who provides an incorrect answer will no longer be eligible to win a Prize in this Contest. The procedure outlined above will be followed until the Prizes in this Contest have been awarded.
The selected entrants will have five (5) days to return their Release & Indemnity Form to the independent contest administrator. If a selected entrant does not return their Release & Indemnity Form within five (5) days, the entrant will be declared ineligible and another entrant will be selected in accordance with these Official Contest Rules.
ENTRIES
All entries become the property of the Sponsor and none shall be returned. By entering this Contest, entrants indicate their consent to their personal information being stored, used and processed for purposes concerning this Contest by the Sponsor. The declared Prize Winners’ information including their names, mailing addresses, telephone numbers and/or e-mail addresses, will be shared with the Sponsor and the independent contest administrator, as required to award the Prizes in this Contest.
RIGHTS RESERVED
The Prizes available in this Contest must be accepted as awarded and are not transferable and no substitutions will be made, whether in cash or otherwise, except at the Sponsor’s sole discretion. The Sponsor reserves the right to substitute a Prize of equivalent or greater value in the event that, for reasons beyond its control, the Sponsor is unable to award a Prize as described in these Office Contest Rules.
In the event that the Contest is not capable of running as planned for any reason, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, including any network server or hardware failure, errors in programming, printing, distribution or production errors or any other errors or other causes of any nature whatsoever beyond the reasonable control of the Sponsor and/or their agencies which corrupt or affect the administration, security, integrity or proper conduct of this Contest, the Sponsor reserves the right to terminate or suspend the Contest, in whole or in part, or modify it in any way, at the Sponsor’s sole discretion, without advance notice, subject to the approval of the the Régie des alcools, des courses et des jeux.
The Sponsor reserves the right to disqualify any individual that it finds to be in violation of these Official Contest Rules and Regulations or tampering with the Contest process. The Sponsor reserves the right to refuse an entry from a person whose eligibility is in question or who has been disqualified or is otherwise ineligible to participate. Entries generated by script, macro, robotic, programmed, or any other automated means are prohibited and will be disqualified. Any attempt by anyone to deliberately undermine the legitimate operation of this Contest is in violation of criminal and civil laws and the Sponsor reserves the right to seek damages or other legal remedy to the fullest extent permitted by law.
GENERAL
By participating in this Contest, entrants agree to comply with these Official Contest Rules and Regulations and with the decisions of the Sponsor and/or the independent contest administrator, which are final and shall be legally binding in all instances.
By participating in this Contest, the Prize Winners agree to sign a Declaration and Release Form in the manner prescribed herein, releasing the Sponsor, the Canadian Tire Parties, and each of their affiliates, respective advertising and promotional agencies, and the independent contest administrator from any liability in connection with this Contest or the Prizes awarded.
By participating in this Contest, all entrants agree to the use of their name, address (city and province only), photo, and/or image on videotape for publicity purposes relating exclusively to this Contest without compensation.
By accepting a Prize in this Contest, the Prize Winners absolve the Sponsor, the Canadian Tire Parties, and each of their affiliates, subsidiaries, advertising and promotional agencies, their respective directors, officers, employees and assigns, harmless from and against any and all claims and liability arising out of or in any way connected with the operation of this Contest and use of a Prize. The Prize Winners assume all liability for any injury or damage caused, or claimed to be caused, by participation in this Contest or use or redemption of a Prize.
In the event of a dispute regarding the identity of the person entering the Contest electronically, the entry will be deemed to be submitted by the "authorized account holder" in whose name the e-mail account is registered, provided that person meets all eligibility criteria of this Contest. "Authorized account holder" shall mean the natural person assigned to an e-mail address and/or telephone number, by an Internet service provider, on-line service provider, telephone service provider or other organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. The sole determinant of the time for the purposes of a valid online entry in this Contest will be the contest server machine(s).
This Contest and the terms and conditions contained in these Official Contest Rules and Regulations, shall be exclusively governed by and construed in accordance with the laws of the Province of Ontario, Canada and the federal laws of Canada applicable therein. Any dispute arising hereunder shall be adjudicated solely in the applicable court in Toronto, Ontario, Canada.
This Contest is subject to all applicable federal, provincial and municipal laws and regulations. Void where prohibited.
For Quebec residents: Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
